Can a Spouse Drive a Rental Car?

Renting a car offers freedom and flexibility during your travels. When it comes to road trips and traveling long distances, having someone to share the amount of driving required to get to your chosen destination is a huge help. A common question that arises is, can your spouse or partner legally drive the rental car if their name isn't on the contract? The answer is generally yes, with a few things to consider for a smooth and safe ride.

Hitting the Road Together: Can Your Spouse Drive Your Rental Car?

Many rental car companies automatically include spouses and domestic partners as authorized drivers without an additional fee as long as they meet the minimum age requirement. This policy is particularly convenient for couples traveling together, as it allows both individuals to share driving responsibilities without incurring extra costs. However, it’s essential to confirm this with your rental company, as policies can vary.

  • Double-Check the Rental Agreement: While most companies allow spouses to drive, it's always wise to review the rental agreement. Look for a section on authorized drivers and if you have any doubts, clarify with the rental car agent.
  • Bring Proof of Relationship: In some instances, the rental company might request proof that your spouse is indeed your spouse. Having a marriage certificate or another valid form of identification readily available can help avoid delays.
  • Meet Age and License Requirements: Ensure your spouse has a valid driver's license and meets the rental company's age requirement.

If you want to add someone other than your spouse as an authorized driver of your rental car, there will likely be an additional fee per day. Also be aware that some rental companies may impose age restrictions on additional drivers, especially those under 25 years old. These restrictions might come with higher fees, too.

Knowing you're insured in case of an unexpected event can provide peace of mind while you're on the road, especially in a rental car. Can Someone Besides Your Spouse Drive Your Rental Car?

While spouses often get a free pass as authorized drivers, adding a non-spouse driver such as a friend, family member, roommate, etc. of a rental car typically comes with an extra daily fee. In most cases, a non-spouse can drive your rental car, however, there are a few key things to keep in mind before you hand over the keys:

  • Authorized Drivers and Fees: Rental companies typically allow you to add additional drivers to your rental agreement. While spouses are often included for free, non-spouses will likely incur an additional daily fee.
  • Age Restrictions: There's usually a minimum age requirement to rent and drive a car, which is generally 25 years old. Some companies might have stricter age limitations for non-spouses compared to spouses.

Keep in mind that the primary driver (and any authorised additional drivers) are financially responsible for anything that happens during the duration of the car rental agreement. That includes any incidents, damage, or violations caused by them or their additional driver. Allowing an unauthorized driver to operate your rental vehicle may inadvertently cancel any liability protection under the rental agreement which could be very costly if the car is involved in an accident.
